Lisa v. The State of California

Lisa was driving with her daughter on I-580 in the City of Dublin when a van driving on the other side of the highway lost control, crossed over the median divide and struck Lisa's car head-on. Lisa suffered a serious head injury. Lisa's daughter suffered minor injuries that included a fractured rib.


Not only did our law firm sue the negligent driver, but our investigation revealed that the highway was undergoing major construction and this contributed to the driver losing control, and so we sued the four construction companies involved in the work.


We also discovered that the median divide was a cable barrier, which was outdated, dangerous and did nothing to prevent the out-of-control van from crossing over the median divide, and therefore we also sued the State of California for Negligent Highway Design.

Recovery amounts per Defendant:


  1. Negligent Driver:  $1m. ($853,000 to Lisa, $75,000 to Lisa's Husband Hans, $75,000 to Lisa's Daughter Laci.)
  2. State of California:  $3.4m.*
  3. CSS Planning & Engineering:  $650,000.
  4. S&C Engineers: $500,000.
  5. DeSilva Gates Construction: $285,000.*
  6. Chrisp Company:  $215,000.


*Note: The reason the check amounts are lower than the settlement amount is that a portion of the settlement was used to purchase a structured settlement that paid Lisa's daughter (a minor) the sum of $151,406.00 and $214,417.00 when she turned 21 and 25.  Payment was  made to Lisa's husband for loss of consortium.
