This AC Transit bus accident occurred on February 15, 2001. Mrs. Tate uses a motorized scooter to get around due to a severe condition of rheumatoid arthritis.

She was aboard an AC Transit bus on her scooter when the bus made a sharp turn.

Plaintiff was thrown off her scooter because the driver failed to properly secure her in place. Plaintiff landed hard on her left shoulder. Plaintiff suffered a rotator cuff injury to her left shoulder that required surgical repair.

This was an important case for people with physical disabilities as it will help ensure that they have access to safe public transportation. This case was reported in the Oakland Tribune.
